Once in a while, a Democrat gets it right.  It’s rare, yes, but it happens.  When it does, we like to point it out.

This time, it’s Senator Jim Webb (D) of Virginia, who sent Barack Obama the following letter:

Dear Mr. President:

I would like to express my concern regarding reports that the Administration may believe it has the unilateral power to commit the government of the United States to certain standards that may be agreed upon at the upcoming United Nations Framework Convention on Climate Change Conference of Parties 15 in Copenhagen, Denmark. The phrase “politically binding” has been used.

Although details have not been made available, recent statements by Special Envoy on Climate Change Todd Stern indicate that negotiators may be intending to commit the United States to a nationwide emission reduction program. As you well know from your time in the Senate, only specific legislation agreed upon in the Congress, or a treaty ratified by the Senate, could actually create such a commitment on behalf of our country.

I would very much appreciate having this matter clarified in advance of the Copenhagen meetings.

The letter was sent on November 25th and, unfortunately, Webb didn’t get his wish.  There has been no response from Obama.  What a shock.

We can only wonder what might have caused Webb to remind Obama that, at least for the moment, we still have checks and balances.  Regardless, our hat’s off to the Senator. 

Well done, sir.

Now we just need to make sure that Webb, and others like him, hold the line if Obama decides to sell us all down the global-warming river.

    So, has congress had to ratify every other pact or treaty the president signs? Or is this another one of those things that’s only an issue because it’s Obama?

    Thank you, Senator, for reminding a Constitutional scholar of what’s contained in the constitution. I’m pretty sure Obama knows the law. It is customary for a nation’s leader to negotiate on behalf of the nation, and bring back a treaty for ratification.

    Senator: I voted for you, and contributed to your campaign for this sort of empty posturing? I expect more, and you should know better.

  5. Sevon: This has always been true, and is, in fact, covered in the Constitution. And not the “living, breathing” Constitution that some people would like to have, but the actual written, amended, agreed upon Constitution we’re supposed to operate on. You might try reading it sometime. They used generally simple words so even socialists could understand it.

    Like that Montreal Protocol Congress passed, and the Kyoto one they refused to.

    Vic: 0bama is a piss-poor Constitutional scholar, who has arrogated to himself a lot of authority he doesn’t have, and has tried to ignore large chunks of procedure, policy and the Constitution he doesn’t like. He’s not the first to do this, so please don’t whine, because multiple wrongs do not make a right.

    A little research will reveal that the first people to suffer from any kind of agreement on carbon (that stuff that all life depends on, you know?) are miners and industrial workers–typically Democrat-voting, American laborers. Senator Webb is taking care of his constituents rather than selling out for some socialistic BS. This is what Democrats are supposed to do. Or at least, were supposed to do, before socialist scumbags perverted the party.

    Yes sevon, the senate must ratify a treaty before it is the law of the land. I suggest you retake a 5th grade civics class.

    So who was reminding Bush back when everyone in Congress during the Repub majority seemed to be accepting all those signing statements and de-facto line item vetoes as law?

    Knowing the law and following the law are two different things. I am pretty sure that the constitution mentions nothing about healthcare in it but the constitutional scholar knows he can shove it through tax & spend or interstate commerce despite that never being intended by the founding fathers. So yes he may know the law but that doesn’t prevent him from circumventing it.
